Terms of service
These terms govern your use of buildorpass.lol and the paid BuildOrPass project-review service.
Acceptance and eligibility
By submitting a pitch, you confirm that you are at least 18 years old, can enter a binding contract, and are authorized to act for the named customer or business. You also accept the review rules, refund policy, delivery policy, and acknowledge the privacy policy.
The review service
The displayed US$2 or ₹199 charge purchases a human review of one submitted brief and a BUILD or PASS decision. It is not a development deposit, quotation, investment, contest entry, or promise of acceptance. We begin the review after our server verifies captured payment.
Fees, currency, and taxes
Razorpay processes payment and shows the methods available for the selected currency. Your bank may impose conversion or international-transaction fees that we do not control. Displayed prices include only the BuildOrPass review charge; taxes required by law may be handled or invoiced separately.
One answer; no negotiation
The submitted maximum budget is a ceiling for the described outcome, not a guaranteed price. BUILD or PASS concludes the paid review. Clarifying an ambiguous fact does not create a negotiation or require either party to accept changed scope, price, or timing.
BUILD is conditional
BUILD means we are willing to explore delivery within the submitted ceiling, subject to identity and compliance checks, technical feasibility, mutually accepted scope, and a separate signed project agreement. Unless we confirm otherwise, the BUILD invitation expires seven days after the decision. The project deposit is unavailable until that agreement is recorded as signed. No development begins merely because BUILD was issued.
Private project portal
After an accepted project is funded, the private status page may show milestones, links, deliverables, invoices, and approval requests. Portal progress is operational information and does not replace the signed project agreement. Approval actions are attributed to whoever controls the private access link, so the customer must keep that link secure and tell us promptly if it may have been exposed.
Separate project agreement
Any accepted development project must have its own written agreement or statement of work covering scope, milestones, price, taxes, acceptance, dependencies, intellectual-property transfer or licensing, confidentiality, support, termination, refunds, and dispute handling. If that project agreement conflicts with these terms about development work, the signed project agreement controls.
Your content and permissions
You keep ownership of materials you submit. You grant us a limited, worldwide permission to host, copy, review, and use them only to operate the service, prevent abuse, keep required records, and perform a later signed project agreement. Public display requires the separate choice and consent described in the publication policy.
Your promises
You promise that your submission is accurate, lawful, and does not violate another person’s privacy, confidentiality, contract, or intellectual-property rights. Do not submit passwords, private keys, payment-card data, health records, confidential source code, export-controlled material, or regulated data unless a later written agreement expressly permits and protects it.
Prohibited use
You may not use BuildOrPass for unlawful, deceptive, infringing, exploitative, abusive, adult, gambling, weapons, malware, credential theft, unauthorized surveillance, sanctions evasion, or security-circumvention projects. We may reject, preserve evidence of, or report suspected unlawful activity where legally required.
Electronic communications
You consent to receive transactional notices, receipts, decisions, agreement updates, and security messages electronically at the submitted email address. Electronic actions and records may be used as evidence of your choices, but an on-site checkbox does not replace the separate signature required for a BUILD project agreement.
Third-party services
Hosting, database, payments, email, and anti-abuse functions depend on third-party providers. Their services may be unavailable or governed by additional terms. We are not responsible for bank, card-network, internet, or third-party outages outside our reasonable control.
Service changes and termination
We may change or suspend the service for security, law, maintenance, or business reasons. Changes do not remove refund or consumer rights already earned. We may cancel and refund a submission rather than review content that creates legal, safety, or operational risk.
Disclaimers
The review service is provided on an “as available” basis. A BUILD or PASS decision is a commercial judgment, not legal, financial, security, accessibility, tax, or regulatory advice. To the maximum extent the law permits, we disclaim implied warranties, while preserving warranties and remedies that cannot lawfully be excluded.
Liability
To the maximum extent permitted by law, neither party is liable under the review service for indirect, incidental, special, exemplary, or consequential losses. Our aggregate liability arising from a review is limited to the review fee paid. These limits do not apply to fraud, wilful misconduct, confidentiality or intellectual-property obligations, or liability that the law does not permit us to limit.
Indemnity
If your unlawful content or unauthorized instructions cause a third-party claim against us, you will reimburse reasonable losses and defence costs to the extent permitted by law and attributable to your breach. This does not limit any non-waivable consumer protection.
Governing law and disputes
These terms are governed by the laws of India, without displacing mandatory consumer rights that apply where you live. Before filing a claim, contact us and allow 30 days for a good-faith resolution. Any dispute must be brought before a court with lawful jurisdiction unless applicable law requires another forum.
Changes and severability
The version accepted at checkout governs that review. We may update these terms prospectively by publishing a new effective date. If one provision is unenforceable, the remaining provisions continue to apply.
